These Terms and Conditions ("Terms") set the rules for using Tangaza Promos to book advertising campaigns, offer vehicles for advertising, and print campaign materials. Please read them before using the platform.
1. About Tangaza Promos
Tangaza Promos ("Tangaza Promos", "we", "us" or "our") operates a digital marketplace that connects advertisers, vehicle owners and printing agencies for advertising on vehicles in Tanzania. The platform supports campaign booking, matching with printing agencies and vehicles, payments, photo verification and campaign tracking. These Terms govern your use of our mobile app, web app and website, together called the "Platform".
2. Acceptance of these Terms
By creating an account, registering a vehicle, publishing or accepting a campaign, accepting a printing job, or otherwise using the Platform, you agree to these Terms. If you use the Platform on behalf of a company or other organisation, you confirm that you are authorised to bind that organisation. If you do not agree, do not use the Platform.
3. Definitions
- Advertiser
- A person or organisation that creates and pays for an advertising campaign.
- Vehicle Owner
- A person or organisation authorised to offer a vehicle for advertising.
- Printing Agency
- A printing or related service provider that prints campaign materials through the Platform.
- Campaign
- An advertising placement booked through the Platform, including its artwork, target areas, dates, vehicles, printing and verification requirements.
4. Eligibility and accounts
You must be at least 18 years old to use the Platform. You must give accurate, current and complete information and keep your account details up to date. Protect your login details and tell us promptly if you suspect someone else has used your account.
We may ask for identity, business, vehicle ownership, registration, insurance, licensing or payment details where reasonably needed, and we may decline or suspend accounts that cannot be verified. Accounts must not be used by anyone who is legally prohibited from doing so.
5. Advertiser responsibilities
As an Advertiser, you are responsible for:
- The accuracy and legality of your advertising claims.
- Owning, or having permission to use, all artwork, logos, photographs, trademarks and other materials you upload.
- Making sure your campaign complies with advertising, consumer protection, intellectual property and other applicable laws.
- Providing final artwork and approving printing proofs on time.
We may reject, pause or remove content that appears unlawful, misleading, unsafe, infringing or against Platform rules.
6. Vehicle owner responsibilities
As a Vehicle Owner, you must:
- Have lawful authority to offer each vehicle for advertising, and give accurate vehicle details and routes.
- Keep your vehicle roadworthy, insured and maintained as the law requires.
- Obtain any permissions needed to display advertising on your vehicle.
- Collect campaign materials from the assigned printing agency and install them as instructed.
- Keep the advertisement in place and undamaged for the whole campaign, unless safety, the law or written campaign instructions require otherwise.
- Send honest installation and daily photos, and promptly report accidents, damage, downtime or problems with campaign materials.
7. Printing agency responsibilities
As a Printing Agency, you must keep your business location and details accurate, and accept or decline printing jobs promptly. When you accept a job, you must print only the artwork approved for that campaign, upload a proof for the Advertiser to approve, meet agreed quality standards and deadlines, and have materials ready for vehicle owners to collect.
You must not substitute materials, change artwork or add charges without approval. If you cannot meet a deadline or quality requirement, tell us and the parties involved straight away so the job can be reassigned.
8. Campaign booking
A campaign is confirmed when the Advertiser has reviewed the campaign details in the app and the payment has been completed. The campaign details include the target areas, vehicle type and number of vehicles, start and end dates, artwork and the total cost.
Estimates, vehicle availability and drafts are not a guarantee until the campaign is confirmed. We match each campaign with a printing agency in each target region and with vehicles whose routes pass the chosen areas, but we cannot guarantee that enough vehicles or agencies will be available in every area.
9. Prices, fees and payment
The total cost of a campaign, including our platform fee, is shown before you pay. Payments are made by mobile money through our payment provider. Vehicle Owners and Printing Agencies receive their earnings in their Tangaza Promos wallet and can withdraw them to mobile money once their available balance reaches the minimum shown in the app.
Our fees and withdrawal limits may change. Any change applies only to campaigns confirmed after it takes effect. You are responsible for any taxes that apply to you unless we state otherwise. You must not misrepresent payments or arrange to pay outside the Platform for a campaign that started on the Platform.
10. Holding and release of funds
When an Advertiser pays for a campaign, we hold the funds and release them as each step is completed. Printing Agencies are paid once the vehicles carrying their materials go live, and Vehicle Owners are paid for each day their advertisement is verified on the road. Holding funds this way is not a bank deposit or a guarantee.
When there is a question about releasing funds, we may ask for evidence such as installation photos, daily photos, proofs or confirmation from the Advertiser.
11. Campaign delivery and verification
Campaign delivery depends on vehicle availability, routes, traffic, weather, network coverage and other factors outside our control. Our team reviews each installation photo, and Vehicle Owners send a new photo every day the campaign runs, which the Advertiser can follow in the app.
Unless a signed campaign agreement guarantees it, we do not guarantee any number of views, reach, sales, leads or return on investment. You must not falsify photos or other campaign evidence.
12. Creative rights and intellectual property
Each party keeps the rights it already owns in its trademarks, materials and other intellectual property. Advertisers give Tangaza Promos and the Printing Agencies and Vehicle Owners on their campaign a limited, non-exclusive permission to use the campaign materials only to print, install, display, verify and report on that campaign. Advertisers confirm they have the rights needed for this.
Tangaza Promos keeps all rights in the Platform, its branding, design and software. No party may use another party's brand outside the agreed purpose without written permission.
13. Cancellations, changes and refunds
If you need to cancel or change a campaign, contact us as soon as possible. We will work out a fair outcome based on the work already completed, costs already committed to printing agencies and vehicle owners, and services not yet delivered. Any refund is paid to the original payment method and may take time to process depending on the payment provider.
If a campaign cannot go ahead because no printing agency or vehicles are available in a target area, we will contact you to change the campaign or refund the part that cannot be delivered.
14. Complaints and disputes between users
You can raise a dispute about a campaign from the campaign page in the app. Please keep records and evidence. We may review the evidence, ask the parties for more information, pause a disputed payment, and make a decision under these Terms.
Unless a separate written agreement says otherwise, Tangaza Promos is not the advertiser, vehicle owner or printing agency on a campaign and does not take on their obligations. Nothing in these Terms removes rights that cannot legally be excluded.
15. Prohibited conduct
You must not:
- Give false or misleading information.
- Upload unlawful, deceptive, discriminatory, defamatory or infringing content.
- Offer or accept bribes, or commit fraud.
- Interfere with the security of the Platform or with campaign verification.
- Misuse other people's personal information.
- Avoid Platform fees by deceptive means.
- Damage vehicles or campaign materials.
- Use the Platform for any unlawful activity, or interfere with another user's lawful campaign.
We may investigate suspected violations and take proportionate action, including suspending accounts.
16. Privacy and data
Our Privacy Policy explains what information we collect, why we use it, who we share it with, how long we keep it and how you can exercise your privacy rights. You must not collect, disclose or misuse another person's data without a lawful basis.
17. Availability and third-party services
The Platform may be updated, interrupted or temporarily unavailable for maintenance, security, technical problems or events outside our reasonable control. Payment providers, mobile networks, mapping services and other third parties have their own terms and limitations. We do not guarantee uninterrupted access, but we will make reasonable efforts to fix significant problems.
18. Disclaimers and limitation of liability
To the extent permitted by law, the Platform is provided "as available". We do not guarantee that a campaign will achieve a particular commercial result, or that everything users tell us is accurate.
Subject to applicable law, we are not responsible for indirect or consequential loss, lost profits or lost opportunities, or for losses caused by a user's breach, unlawful content, vehicle operation, the failure of a third-party service, or events outside our reasonable control. Nothing in these Terms excludes liability that cannot lawfully be excluded, including mandatory consumer rights.
19. Indemnity
To the extent permitted by law, you are responsible for reasonable losses, claims, costs and expenses caused by your breach of these Terms, your unlawful conduct, your infringement of someone else's rights, or your failure to obtain required permissions. This does not apply to the extent a loss was caused by our own breach.
20. Suspension and termination
We may suspend or restrict an account where reasonably necessary to investigate suspected fraud, protect users, comply with the law, address security risks or respond to a serious breach. Where appropriate, we will tell you and give you a way to respond.
You can delete your account at any time in the app, or on our account deletion page. Ending an account does not cancel obligations or payments on a campaign that has already been confirmed.
21. Changes to the Platform or these Terms
We may update the Platform and these Terms from time to time. Updated Terms will be published on this page with a new effective date. Where the law requires notice or consent for a significant change, we will provide it.
22. Governing law and dispute resolution
These Terms are governed by the laws of the United Republic of Tanzania. If a dispute cannot be resolved through our dispute process, it will be referred to the courts of Tanzania.
23. General provisions
If any part of these Terms is found unenforceable, the rest continues to apply. A delay in enforcing a right does not waive it. You may not transfer your account or obligations without our consent. These Terms, together with the campaign details, our fees as shown in the app, the Privacy Policy and any signed agreement, form the agreement between you and Tangaza Promos.
